
Real Estate Agents - SB 410 (Grayson) is important to know!

As of January 1, 2026 Senate Bill 410 (SB 410), authored by Senator Tim Grayson and signed into law in October 2025, introduces important changes to property disclosures.
Key Background: The Underlying Inspection Requirement
SB 410 builds on existing “balcony laws” from SB 326 (2019), codified in Civil Code § 5551. This requires HOAs in condominium projects (buildings with 3 or more attached multifamily units) to conduct mandatory inspections of exterior elevated elements (EEEs) — things like balconies, decks, stairs, walkways, and railings that are more than 6 feet above ground and supported substantially by wood.
These inspections were inspired by tragedies like the 2015 Berkeley balcony collapse.
What SB 410 Changes (Effective Now)
SB 410 closes a previous disclosure gap by mandating that sellers in HOAs provide buyers with the most recent EEE inspection report:
•Amends Civil Code § 4525: Adds the EEE inspection report to the list of required documents sellers must deliver to prospective buyers “as soon as practicable” before transfer of title.
Impact on Real Estate Transactions:
•Sellers (your clients) are now legally required to include this report in the disclosure package.
